Die Reedition der von den Verfassern nunmehr Excerpta Vaticana et Laurentiana genannt wird, findet ihre Begründung darin, dass der Erstherausgeber, der berühmt Rechtshistoriker Contardo Ferrini offenbar auf eine Kollationierung beider Codices verzichtet hat und im Übrigen, aus welchen Gründen auch immer, bei der Edition selbst nicht unwesentliche Versehen verschuldet hat. Der Codex Vaticanus Palatinus ist wohl in der ersten Hälfte des 14. Jahrhunderts entstanden, der Codex Laurentianus 80.6 in der ersten Hälfte des 15. Jahrhunderts. Grundsätzlich sind die Verfasser der Meinung, (...) die mit zahlreichen plausiblen Argumenten vorgetragen wird, dass der Schreiber des Codex Laurentianus 80.6, ein gewisser Stephanus of Medea, als Vorlage den heutigen Codex Vaticanus Gr. 19 vor sich liegen hatte, und als intelligenter Kopist verschiedene Emendationen vorgenommen hat. Eine große Mehrheit der Fragmente der Excerpta Vaticana et Laurentiana von 1–193 muss einem Juristen Anatolius zugeschrieben werden. Jene Person, die sie zusammengestellt hat, muss ein altes Manuskript mit der Summa Codicis des Anatolius verwendet haben. In dieser Summa waren die Termini technici immer noch in lateinischer Sprache verfasst. Zur Selektion der Texte führen die Verfasser an, dass überdurchschnittlich großes Interesse dem Strafrecht und dem Familienrecht gewidmet ist, während etwa Eigentumserwerb, Erbrecht und große Teile des Obligationenrechtes kaum Behandlung finden. Die Exzerpierung der Summa Codicis muss aus diesem Grunde von jemand vorgenommen worden sein, der eine besondere Affinität gerade zu diesen Bereichen des Rechtes hatte. Nach diesen grundsätzlichen und grundlegenden Ausführungen, die ich allesamt nicht nur begrüße, sondern voll mittragen möchte, widmen sich die Verfasser kurz aber prägnant der Person des Anatolius (24–30). Ein Anatolius wird zusammen mit sieben anderen Antecessores in der Constitutio Omne genannt, sowie in der Constitutio Tanta vom 16. Dezember 533 als einer der vier Professoren, denen die Kompilation der Digesten anvertraut worden war. Er bekleidete die Funktion eines Magister Officiorum und wurde aus diesem Grunde als Vir Illustris bezeichnet. Anatolius entstammte einer Juristenfamilie aus Beirut und lehrte dort selbst als Professor. Zachariae von Lingenthal (Griechische Bearbeitung des Codex 70) und Van der Waal (Comentar 111) hatten die Ansicht vertreten, dass es zwei Anatoli gegeben habe: Der eine Mitglied der justinianischen Kompilation, der andere der Autor des Codex-Kommentares. Dem gegenüber vertreten die Autoren die Ansicht, dass Anatolius ein einziger gewesen sei, der, nachdem er maßgeblich an der Kompilation in Konstantinopel mitgearbeitet hatte, etwa zwischen 530 und 533 als Lehrer nach Beirut zurückgekehrt sei, um dort an einer der prestigeträchtigsten Universitäten des Reiches die neue juristische Studienordnung durchzusetzen und ruhmreich zu begründen. Der Kommentar des Codex diente dazu, einen grundsätzlichen lateinischen Text griechischen Studenten zu verdeutlichen, und zwar ausgehend von einer reinen Übersetzung bis zu einem juristischen Kommentar. Die Autoren lösen die Quellenproblematik derart, dass sie davon ausgehen, dass Anatolius das Buch 4 seines Kommentares noch in Konstantinopel vollendet und mit dem 8. Buch des Kommentares in Beirut wieder begonnen hat. Die klare und deutliche Argumentationsweise der Autoren, unpolemisch aber doch tiefgreifend, sollte in Zukunft übernommen werden. (shrink)

There is no natural and pretheoretical classification of colour appearances into hue, saturation, brightness, unique hues, and so on. Rather, our theoretical insights into the coding of colour have reciprocally shaped the way we talk about colour appearances. Opponency is only one of many fundamental aspects of colour coding, and we are hardly justified in ascribing some theoretical prominance to it.

In his book “Medical Philosophy: Conceptual issues in Medicine”, Mario Bunge provides a unique account of medical philosophy that is deeply rooted in a realist ontology he calls “systemism”. According to systemism, the world consists of systems and their parts, and systems possess emergent properties that their parts lack. Events within systems may form causes and effects that are constantly conjoined via particular mechanisms. Bunge supports the views of the evidence-based medicine movement that randomized controlled trials (RCTs) provide the best (...) evidence to establish the truth of causal hypothesis; in fact, he argues that _only_ RCTs have this ability. Here, we argue that Bunge neglects the important feature of patients being open systems which are in steady interaction with their environment. We show that accepting this feature leads to counter-intuitive consequences for his account of medical hypothesis testing. In particular, we point out that (i) the confirmation of hypotheses is inherently stochastic and affords a probabilistic account of both confirmation and evidence which we provide here; (ii) RCTs are neither necessary nor sufficient to establish the truth of a causal claim; (iii) testing of causal hypotheses requires taking into account background knowledge and the context within which an intervention is applied. We conclude that there is no “best” research methodology in medicine, but that different methodologies should coexist in a complementary fashion. (shrink)

This paper is a historical, legal and philosophical analysis of the concept of human dignity in German and Kenyan constitutional law. We base our analysis on decisions of the Federal Constitutional Court of Germany, in particular its take on life imprisonment and its 2006 decision concerning the shooting of hijacked airplanes, and on a close reading of the Constitution of Kenya. We also present a dialogue between us in which we offer some critical remarks on the concept of human dignity (...) in the two constitutions, each one of us from his own philosophical perspective. The present volume contains the lectures and papers given at the 1994 international conference on hermeneutics in Halle (Germany). The conference aimed at a state of the art in the light of recent developments in science and humanities. The place in which the conference was held is renowned for its centuries-old tradition in hermeneutics and among the lectures there are indeed some devoted to this history. For the most part, however, the papers concentrate on present-day problems in fields as different (...) as comparative literature, religious studies, bible exegesis, esthetics, social sciences, intercultural dialogue. The theme of the conference, "strangeness and familiarity", reflects the tension in which any interpretation process is situated and that any theory of interpretation has to account for. AimThe neurocognitive basis of Developmental Coordination Disorder remains an issue of continued debate. This combined systematic review and meta-analysis provides a synthesis of recent experimental studies on the motor control, cognitive, and neural underpinnings of DCD.MethodsThe review included all published work conducted since September 2016 and up to April 2021. One-hundred papers with a DCD-Control comparison were included, with 1,374 effect sizes entered into a multi-level meta-analysis.ResultsThe most profound deficits were shown in: voluntary gaze control during movement; cognitive-motor integration; practice-/context-dependent (...) motor learning; internal modeling; more variable movement kinematics/kinetics; larger safety margins when locomoting, and atypical neural structure and function across sensori-motor and prefrontal regions.InterpretationTaken together, these results on DCD suggest fundamental deficits in visual-motor mapping and cognitive-motor integration, and abnormal maturation of motor networks, but also areas of pragmatic compensation for motor control deficits. Ausgehend von einer Analyse des "Begründungsstreits", der in den letzten Jahren im Anschluß an H. Alberts Kritik des methodischen Prinzips der Begründung v.a. in der deutschen Philosophie geführt worden ist, werden zunächst die Positionen von K. O. Apel und J. Habermas einer immanenten methodischen Kritik unterzogen. Beide Programme erweisen sich als undurchführbar. Ausgehend von einer Präzisierung des Begriffes "Begründung" wird durch systematische Einführung begründungstheoretischer Termini ein begriffsiches Instrumentarium vorgeschlagen, das eine Rekonstruktion von Begründungssituationen erlauben soll. Mit seiner Hilfe werden die (...) im "Münchhausen-Trilemma" unterstellten Begründungssituationen genauer analysiert. Das "Münchhausen-Trilemma" wird als Argumentation für eine konstruktivistische und gegen eine reduktivistische Begründungskonzeption gewertet. (shrink)

En el primer apartado se esbozarán brevemente las principales conclusiones de una fenomenología del sueño tal fueron formuladas desde Husserl a Th. Conrad. En el segundo se contrastará con ellas la crítica de J. Iribarne. En el tercero se examinarán la solidez de sus objeciones antes de (...) intentar, en el último apartado, desde la pregunta central sobre la producción de la realidad en un sueño, formular un resultado que lleva un poco más lejos, pero que igualmente solo puede ser provisional.In a 2002 essay, Julia Iribarne subjected to criticism some phenomenological theories on sleep, adding some descriptions of phenomena. This essay critically evaluates the contribution of Iribarne. In the first section, it briefly outlines the main conclusions of a phenomenology of sleep that were made from Husserl to Th. Conrad. The second, it contrasts these theories with Iribarne's criticism. The third part examines the strength of their objections, before attempting to formulate, in the fourth and final section, from the central question about the production of reality in a sleep, a result that takes a little further, but it also can only be provisional. The volume brings together contributions in the spirit embodied by Marek J. Siemek and Jakub Kloc-Konkołowicz, two Warsaw philosophers truly devoted to Classical German Philosophy. They were simultaneously in a relationship between thinker and adept, and thinker and thinker. They both taught philosophy, with a strong emphasis on classic German philosophy, at Warsaw University. Under the theme “Ethical Theory in Classic German Philosophy Then and Now,” students and companions continue their discussions with both of them.

This interdisciplinary book examines the work of several female artists since 1960 in the areas of dance, music, installation, photography, architecture, poetry, literature, theater, film, and performance art. Each chapter is primarily devoted to an important work by a single artist, seen within its historical context, and with particular attention to how each artist incorporated gender issues or feminist thought into her respective art form. Laurie Anderson, Gwendolyn Brooks, Jane Campion, Judy Chicago, Zaha Hadid, Pauline Oliveros, Yvonne Rainer, Cindy (...) Sherman, Amy Tan, and Paula Vogel have each made groundbreaking contributions to their fields. As a group, they represent a tremendous diversity of approaches to art making: from accessible to opaque, from overtly feminist to apolitical, from emotive to cool, from controversial to mainstream. O artigo visa discutir o papel que a obra de John Rawls possui para o projeto teórico de Rainer Forst. Trata-se de acompanharas principaisleituras que Forst realiza sobre esse autor e discutir algumas consequências que podem ser delas depreendidas para seu modelo crítico. Assim, em primeiro lugar, discute-se a tentativa de Forst em aproximar os critérios de reciprocidade e universalidade, de seu princípio de justificação, à teoria de Rawls, ao mesmo tempo em que acusa Rawls de que sua configuração (...) da posição original atribui conteúdos substantivos aos princípios de justiça, que, na verdade, só poderiam ser concebidos comoum princípio fundamental de justificação (I). Em seguida, observa-se a leitura que Forst realiza sobre o debate entre Habermas e Rawls, a fim de extrair uma alternativa a ambos. Novamente Forst faz um movimento de aproximação e crítica a Rawls (II). Em um terceiro momento, examina-se outra tentativa de aproximação e superação à obra de Rawls, mas dessa vezatravés da distinção entre duas imagens da justiça(III). Por fim, o artigo apresenta duas interpretações gerais sobe essas leituras: que existem certas constantes nos argumentos que unem e que pretendem superar Rawls; e que contém possíveis problemas,com consequências que ocasionam certos entraves para sua teoriaem sua pretensão de ser crítica. Artykuł dotyczy dwóch bardzo mało znanych utworów słynnych twórców literatury niemieckiej. Johann Wolfgang von Goethe, twórca Fausta, ma w swym dorobku moralizatorski wiersz pt. Dziennik. Jednak z obawy o posądzenie go o niemoralne treści, nigdy za życia poety utwór ten nie został opublikowany. Również Siedem wierszy Rainera Marii Rilkego jest bardzo rzadko drukowanych. Mimo, iż Rilke długo wzbraniał się przed lekturą utworów niemieckiego wieszcza, to jednak Dziennik stanowił wyjątek. Wiersz Goethego poświęcony jest kryzysowi seksualnemu i twórczemu bohatera, za którym kryje (...) się sam poeta. Wiersze Rilkego stanowią cykl poświęcony aktowi miłosnemu dwojga kochanków. Artykuł stara się przeanalizować wzajemne związki obu tych tak różnych dzieł i odpowiedzieć na pytanie, czy R. M. Rilke wzorował się na twórczości J. W. Goethego. (shrink)
